    I agree with you Aubs it is insane that this trial has gone so long with delays makes me furious too!! Shame on the Defense attorneys and the judge that listens to them!!! Outrageous!!!!!!!!

    Sierra LaMar judge: No cameras during trial

    SAN JOSE -- The judge in the upcoming trial of missing teen Sierra LaMar's alleged killer Antolin Garcia-Torres has ruled that no cameras will be permitted in the courtroom during the capital murder trial, expected to begin next month.

    Superior Court Judge Vanessa A. Zecher made the ruling last week, rejecting requests by TV stations and this newspaper to film or photograph what is expected to be at least a four- to six-month trial. Jury selection in the trial could start next month.

    This morning, the judge could rule on whether to make public a motion she conditionally sealed last month. The motion, filed by Garcia-Torres' lawyers Brian Matthews and Al Lopez, asks the judge to exclude certain evidence from the trial.

    Judge Denies Further Delays in Sierra LaMar Murder Case

    The case started four years ago when the Morgan Hill teen disappeared while walking to a school bus stop.

    The Santa Clara County Superior Court judge in the Sierra LaMar murder case on Monday denied the defendant's request to further postpone the trial any longer, four years after the Morgan Hill teen disappeared from a bus stop near her home.

    The accused killer, Antolin Garcia-Torres, and his legal team had asked that the court hold off until October 10 to commence trial proceedings, but that request was denied by Justice Vanessa Zecher. She said she found no good reason to further postpone the trial, which has already dragged on since shortly after Torres-Garica's arrest in May 2012.

    Still, the trial will not start immediately. The judge scheduled motions for August 31 and tentative jury selection for September 19.

    SAN JOSE -- Key rulings are expected later today that could determine where the upcoming trial of missing teen Sierra LaMar's accused killer will be held and what evidence prosecutors can use against him.

    Citing extremely negative pretrial publicity, lawyers for defendant Antolin Garcia-Torres, 22, have asked Superior Court Judge Vanessa A. Zecher to move the capital trial out of Santa Clara County.

    They have also asked Zecher to exclude statements Garcia-Torres made to sheriff's deputies, as well as evidence found during the search of his home and car.

    Garcia-Torres told them that he did not know the Morgan Hill teen and that he was in the area at the time of her March 16, 2012, disappearance, according to the grand jury transcript. Yet the prosecution contends that his DNA was discovered on her pants, which were found on the side of a road in South County.

    In court documents, defense lawyers Brian Matthews and Al Lopez argue that the search warrant in the case was invalid because deputies left out key information about DNA from other people found on the pants to strengthen the case against Garcia-Torres, rendering any evidence that was seized inadmissible.

    They also contend that compelling Garcia-Torres to provide his DNA in 2010 when he was arrested on suspicion of breaking his brother-in-law's nose during a fight, was a violation of his constitutional rights against unreasonable search and seizure. The charges against him in that matter were dismissed.

    Also today, an expert hired by the defense to support their contention that the trial should be moved is expected to take the stand.

    SAN JOSE (BCN)—A professor emeritus testified today in a hearing on a motion in Santa Clara County Superior Court that if granted, would move the location of an upcoming trial for a man facing charges associated with the 2012 disappearance of 15-year-old Sierra LaMar.

    Attorneys representing the defendant, 25-year-old Antolin Garcia-Torres, have filed a change of venue motion as they’re looking to move his trial outside Santa Clara County.

    A professor emeritus testified Wednesday in a hearing on a motion in Santa Clara County Superior Court that if granted, would move the location of an upcoming trial for a man facing charges associated with the 2012 disappearance of 15-year-old Sierra LaMar.

    Attorneys representing the defendant, 25-year-old Antolin Garcia-Torres, have filed a change of venue motion as they're looking to move his trial outside Santa Clara County.


    Garcia-Torres has been charged with the kidnapping and murder of Sierra, who was last seen leaving her unincorporated Morgan Hill home on March 16, 2012 and never made it to her bus stop.

    California State University, Chico Professor Emeritus Edward Bronson took the witness stand where he was questioned by defense attorney Brian Matthews before Superior Court Judge Vanessa Zecher at the Hall of
    Justice in San Jose Wednesday.

    The professor has taught courses in constitutional law and criminal procedures. He has a doctorate in law from Denver University a doctorate in political science from the University of Colorado.

    Bronson, 86, has testified in 117 cases in which he favored a change of venue, including the case against Jared Loughner for shooting Rep. Gabrielle Giffords and 18 others in Tucson, Arizona in 2011, but the
    defendant later pleaded guilty.
    In Garcia-Torres' case, Bronson said he was in favor of moving the hearing outside the county based on his analysis of the alleged crime, news reports and a survey he conducted among 300 residents.

    The professor said he understood the "prejudicial effect" of the media before a trial. He analyzed coverage of the case through news articles, a majority from The Mercury News and some by the San Francisco Chronicle.

    SAN JOSE >> More than four years after Sierra LaMar disappeared, a judge Wednesday heard arguments and testimony on two key legal issues that could help determine the fate of the teen’s accused killer — where the capital murder trial will take place and what evidence prosecutors can use to win a conviction.

    Citing extremely negative pretrial publicity, lawyers for defendant Antolin Garcia-Torres, 22, have asked Superior Court Judge Vanessa A. Zecher to move the trial out of Santa Clara County.

    They have also asked Zecher to exclude statements that Garcia-Torres made to sheriff’s deputies, as well as evidence found during the search of his home and car.

    Zecher began hearing arguments on both issues Wednesday in a hearing that is expected to continue through Friday morning. The judge did not indicate whether she would rule from the bench or issue a decision later.

    SAN JOSE (BCN)—A judge is expected to rule by the end of the week on where a trial will be held for a man charged with the kidnapping and murder of 15-year-old Sierra LaMar four years ago.

    Superior Court Judge Vanessa Zecher heard oral arguments on a change of venue motion filed by defense attorneys for the trial of 25-year-old Antolin Garcia-Torres, who was also present during this morning’s hearing at the Hall of Justice in San Jose.

    Zecher is expected to issue a written decision by the end of this week on whether the trial will be held in or out of Santa Clara County.

    The attorney’s arguments were based on testimony heard for three consecutive days last week from Edward Bronson, a professor emeritus at California State University, Chico, who said the trial should be held in another jurisdiction.

    He was brought in as a defense witness to discuss his research on a survey of 300 county residents about the case and more than 100 news articles in the past four years since Sierra’s disappearance.

    Sierra LaMar murder: Judge denies defendant’s request

    SAN JOSE — In a blow to the man accused of killing missing teenager Sierra LaMar, a judge Tuesday refused his request to hold a separate trial on attempted kidnapping charges he also faces involving three other women.

    Antolin Garcia-Torres, 22, is charged with capital murder in the alleged killing of LaMar near Morgan Hill in 2012, and with trying to kidnap the other women in three separate incidents in 2009.

    Judge Vanessa A. Zecher’s ruling in Santa Clara County Superior Court means all four charges will remain linked in a single trial, rather than split into two separate trials. Garcia-Torres had tried to sever the attempted kidnapping charges on the grounds they would unfairly taint his chances of getting a fair trial on the murder charge.

    Earlier this month, defense attorney Al Lopez tried to persuade Zecher that the attempted kidnappings, which occurred in Safeway parking lots in Morgan Hill three years before LaMar vanished in 2012, were actually attempted "purse-snatchings," which his client did not commit.

    Garcia-Torres’ fingerprint was found on the battery of a stun gun the assailant dropped in one of the attempted kidnapping attacks. But Lopez contended that it got there while his client was shelving batteries at one of the Safeway stores in Morgan Hill where he worked, not because he was involved in the attack.

    Prosecutor David Boyd convinced the judge that all four crimes involved a common scheme or plan, and should be litigated together in one trial.

    "The events deal with the defendant brazenly attacking vulnerable females in very public places," Boyd wrote in his trial brief. "The evidence in all instances demonstrates the defendant’s desire to stalk and terrorize his victims with an apparent enjoyment of the chase and the fear he placed in them."

    Boyd declined to comment and Lopez could not immediately be reached.

    In a brief written order that didn’t explain her rationale, Zecher stated, "Although there may be some potential prejudice to the charges remaining joined, the defendant has not made a clear showing of prejudice to support the granting of the motion for severance."

    Sierra LaMar: Jury selection to begin in Morgan Hill teen’s alleged murder

    SAN JOSE — Jury selection is set to begin Monday in the capital-murder trial of a man accused of abducting and killing 15-year-old Sierra LaMar near Morgan Hill more than four years ago.

    Antonin Garcia-Torres has pleaded not guilty to the alleged murder as well as to unrelated charges that he attempted to kidnap other women.

    Hundreds of prospective jurors next week will be asked to fill out a questionnaire, which still was being drafted Thursday afternoon. The case is then set to reconvene in early November after lawyers for the prosecution and defense review the answers on the questionnaires. Questioning of prospective jurors is scheduled to begin Nov. 14.

    One of the biggest challenges will be finding 12 jurors and up to six alternates willing and able to serve during the whole trial, which could last six months.

    In addition, jury selection may take weeks because this is a death penalty case, and jurors must be open to the possibility of imposing the ultimate punishment.

    Jury Selection Begins in Delayed Sierra Lamar Case

    Years after teenager Sierra Lamar disappeared from a Morgan Hill bus stop, the trial against her accused abductor and killer has reached the jury selection process.

    Court officials will poll potential jurors at the Hall of Justice in San Jose Monday beginning at 9 a.m., but the future trial involving Antolin Garcia-Torres could drag out for some time.

    This case is a death penalty case, which means that potential jurors will be asked how they feel about capital punishment. If those citizens have any reservations about convicting someone to death, they will likely not be selected to be a jury member.

    Legal analyst Steven Clark says a jury pool consisting of citizens not concerned with punishing Garcia-Torres to death would be more likely to convict the suspect to death.

    However, a key ballot measure on the upcoming November election could impact Garcia-Torres' fate. If [Only registered and activated users can see links. ] is approved, which would repeal the death penalty in the golden state, all current death penalty cases will be grandfathered in. That decision would result in no more death row convictions.

    I would have no problem with giving this POS death penalty. Makes my blood boil when I hear people say the death penalty is cruel and unusual punishment, seriously, what about their victims death, just ask the families. My sympathy will always be for the victim.
