    State of Maryland vs Officer Caesar Goodson Jr. - Trial - June 9, 2016 *Not Guilty*

    Officer Caesar Goodson Jr., 45, was charged with second-degree murder, manslaughter, second-degree assault, two vehicular manslaughter charges and misconduct in office. Bail $350,000 - Trial: June 6, 2016.

    On April 12, 2015, Freddie Carlos Gray, Jr., a 25-year-old man, was arrested by the Baltimore Police Department for possessing what the police alleged was an illegal switchblade knife. While being transported in a police van, Mr. Gray fell into a coma and was taken to hospital. Mr. Gray died on April 19, 2015; his death was listed as injuries to his spinal cord. On April 21, 2015, pending an investigation of the incident, six Baltimore police officers were suspended. Prosecutors stated that they had probable cause to file criminal charges against the six police officers who were believed to be involved in his death. The officer driving the van was charged with second-degree" depraved-heart" murder for his indifference to the considerable risk that Mr. Gray might be killed, and others were charged with crimes ranging from manslaughter to illegal arrest.

    5 Officers Still Facing Charges in Freddie Gray Death

    Earlier this week a judge found Baltimore police officer Edward Nero not guilty on four misdemeanor charges for his role in the events leading up the arrest and death of 25-year-old Freddie Gray. Gray broke his neck while riding unsecured in the back of a police van in April 2015. His death ignited days of protests and riots in Baltimore, helping to fuel the national Black Lives Matter movement.

    Nero was just one of six officers charged and is the first to receive a verdict. Five more officers will be tried in the coming weeks and months, including Officer William Porter, whose first trial ended with a hung jury.

    Here’s Why Nero Was Found Not Guilty

    “Based on the evidence presented, this Court finds that the State has not met its burden to prove, beyond a reasonable doubt, all required elements of the crimes charged. Therefore, the verdict for each count is not guilty,” Baltimore Circuit Court Judge Barry Williams said Monday.

    Williams determined that prosecutors failed to prove their case against Nero. Williams said he could not find evidence that Nero was involved with detaining and arresting Gray, citing the testimony he heard from fellow Baltimore police officer Garrett Miller, who said he acted alone in handling Gray. Miller, who is also facing charges in Gray’s death and has pleaded not guilty, was granted immunity in Nero’s trial, so his testimony will not affect his impending trial. Moreover, the court said that Nero had "probable cause" to touch Gray and that any contact between the two men was "not unlawful and unwarranted." Williams also found that it was not Nero’s responsibility to seat belt Gray.

    The Baltimore Police Department said in a press release after the verdict that "although the criminal case against Officer Edward Nero has come to a close, the internal investigation has not. With that, Officer Nero's status will remain unchanged. He will remain in an administrative capacity while this investigation continues. The internal investigation is being handled by other police departments. The internal investigation will not be completed until all of the criminal cases against the other five officers are completed because they will likely be witnesses in each case."

    Who’s Next?

    The next officer on trial is Caesar Goodson, who faces several charges, including second-degree depraved-heart murder. Goodson was behind the wheel of the police transport vehicle where prosecutors say Gray suffered his fatal spinal cord injury. Goodson, who is charged with the most serious crime of the six officers, will go on trial June 6. It is unclear whether he wants to be tried by a jury or by a judge.

    Lt. Brian Rice is charged with involuntary manslaughter, second-degree assault, misconduct in office, and reckless endangerment. He will go on trial July 5.

    Officer Goodson, van driver in Freddie Gray case, challenges key evidence ahead of trial

    Officer [Only registered and activated users can see links. ], the next Baltimore police officer scheduled to stand trial in the arrest and death of [Only registered and activated users can see links. ], has challenged the admissibility of key evidence in the state's case against him — including portions of Gray's autopsy and a disputed statement by a fellow officer that Gray said, "I can't breathe," while he was in theircustody.

    Goodson, the driver of the transport van in which prosecutors say Gray suffered a fatal spinal injury, faces the most serious charges in the case, including second-degree depraved heart murder. It carries a maximum sentence of 30 years in prison.

    He also faces manslaughter, second-degree assault and misconduct-in-office charges.

    Circuit Judge Barry G. Williams has scheduled a pretrial hearing Monday to consider Goodson's motions and others filed in the case, the court said Wednesday. Goodson's trial is set to begin Tuesday with jury selection.

    Van Driver Charged In Freddie Gray’s Death Heads To Trial Monday

    BALTIMORE (WJZ) — The officer facing the most serious charges in Freddie Gray’s death heads to trial just days from now. It could be the pivotal case.

    The van driver, Officer Caesar Goodson Jr., is facing more than 30 years behind bars for second-degree depraved heart murder.

    WJZ Investigator Mike Hellgren has more on what to expect.

    A huge fight over what evidence the jury can hear will start on Monday. Unlike the last trial for Officer Edward Nero, this one will focus more on medical evidence and whether Freddie Gray pleaded for help inside the van.

    Prosecutors have placed primary responsibility for Freddie Gray’s death on Officer Caesar Goodson Jr., who drove the transport van. Among the charges he faces: second-degree depraved heart murder, second-degree assault manslaughter and misconduct in office.

    Legal analyst Adam Ruther says the state is again using a unique legal theory.

    “Officer Goodson is being charged for failing to do something that the state claims he had a duty to do, which is to get Freddie Gray the medical attention that he was asking for,” said Ruther.

    The star witness is expected to be fellow officer William Porter, who is being forced to testify.

    (CNN) - The officer who drove the police van in which Freddie Gray was injured heads to trial this week.

    Baltimore police officer Caesar R. Goodson junior has been charged with depraved heart murder, which is considered a second degree charge.

    It carries a maximum sentence of 30 years in prison.

    Goodson also faces three counts of manslaughter and charges of second-degree assault, misconduct in office and reckless endangerment.

    The judge in Goodson's case will hear motions Monday.

    BALTIMORE (WBFF) - A judge on Monday denied a defense motion to redact portions of Freddie Gray's autopsy at the trial for Officer Caesar Goodson.Goodson is the second of six Baltimore Police officers to stand trial in the case. He was the driver of the van during the April 12, 2015 arrest and faces the most serious charges.

    The judge also denied a motion to dismiss charges based on what Goodson's attorneys called a violation of his right to a speedy trial -- as well as a motion to dismiss a second-degree assault charge.

    A defense motion was granted to eliminate a statement made by Officer William Porter to an Internal Affairs detective assigned to investigate the arrest. Shortly after the arrest Detective Syreeta Teel contacted Porter over the phone and testified that Porter reported hearing Gray say, "I can't breathe" at the fourth stop of the police van. Later, on the witness stand, Porter remembered hearing Gray say "I can't breathe" before he was placed in the van for the first time.

    Judge Barry Williams will hold a hearing Thursday on the first day of trial for Officer Caesar Goodson about whether prosecutors wrongly withheld discussions they had with a potential witness in the Freddie Gray case, newly unsealed documents show.

    Attorneys for Goodson are asking Williams to dismiss the charges against him, alleging the failure to disclose the information was a violation of his rights. Documents filed by both sides were filed under seal, but unsealed by Williams on Wednesday.


    The 11th-hour filings revolve around Donta Allen, the second man who was placed inside the police transport van after prosecutors say Gray was severely injured. Police said Allen told investigators that Gray was thrashing around the van, but Allen has publicly recanted that statement and said he only heard a faint tapping, according to court documents.

    Prosecutors dismissed the meeting as inconsequential, saying it produced no evidence because Allen was "consistent with his inconsistence." They say their meeting with him was "farcical" and "unproductive," and they do not intend to call Allen as a witness.

    The Baltimore bench trial of van driver Officer Caesar Goodson in the Freddie Gray case began this morning. At the beginning of the day, Judge Barry Williams found the state had committed a Brady violation by withholding information related to the other inmate who was in the van with Gray for part of the ride. The state has charged Goodson with "depraved heart" murder for the manner in which he drove, failure to restrain Gray with a seatbelt, and not rendering medical aid sooner. The defense says Gray's injuries were an accident, not a crime.
