St of Mass vs. Aaron Hernandez - Convictions Overturned In Odin Lloyd Case 5/9/2017

Victims', Daniel de Abreu and Safiro Furtado

A Closer Look at the Next Aaron Hernandez Murder Trial

The trial of former New England Patriots star tight end Aaron Hernandez for the murder of Odin Lloyd is eight weeks in, with prosecution closing in on resting its case. Jurors and viewers have heard testimony from ballistics experts, witnesses, and family members. Jurors have toured the scene of the crime and viewed detailed photos and video.

But once this trial runs its course and a verdict is reached, regardless of outcome, Aaron Hernandez’s legal team will have to go back to the drawing board for yet another homicide trial for the embattled football star.

On June 27, 2013 — one day after Hernandez was arrested and charged with murdering Lloyd — investigators suggested that Hernandez was possibly connected to a double murder that took place in July of 2012 in Boston’s South End.

In the early morning hours of July 16, 2012, Daniel Jorge Correia de Abreu, 29, and Safiro Teixeira Furtado, 28 — both residents of Dorchester — were shot to death in their BMW sedan. Following a lengthy investigation, on May 15, 2014, Hernandez was indicted in the murders of De Abreu and Furtado, as well as charges of armed assault and attempted murder (he allegedly fired shots at the vehicle’s three surviving occupants, one that was shot and two that fled the scene) .

If this is news to you, or if this has become buried under the deluge of current Hernandez trial information you’ve seen as of late, allow us to explain the events that led to the murder charges.

Before we get to what allegedly happened that night, we should run down the players. First, the victims.

De Abreu and Furtado were close friends, and both attended school and served in the military in Cape Verde before coming to the United States. Furtado worked as a tour guide in Cape Verde before arriving in Dorchester five months prior to the shooting to reconnect with his mother and sister. De Abreu was a police officer in the island country located in the central Atlantic Ocean about 350 miles off the coast of West Aftrica, and arrived in Dorchester around 2008. They became friends while working for a local cleaning company

Aaron Hernandez case goes before SJC

Aaron Hernandez case goes before SJC
    Globe Staff May 03, 2016

[Only registered and activated users can see links. ]

Suffolk County prosecutors went before the state’s highest court Tuesday to ask the justices to order lawyers for Aaron Hernandez to turn over a cellphone they believe contains relevant evidence in the former New England Patriots star’s upcoming double murder trial.

Hernandez, 26, faces two counts of murder and weapons charges for the July 2012 fatal shootings of Daniel de Abreu and Safiro Furtado in Boston’s South End.

He is also charged with witness intimidation for allegedly shooting an associate, Alexander Bradley, in February 2013 in Florida because he feared Bradley would implicate him in the slayings.

A trial date has not been set. Hernandez has pleaded not guilty.

Prosecutors believe the phone in question, which formerly belonged to Hernandez and which is currently in the possession of Rankin & Sultan, the Boston firm representing him, contains evidence relating to his alleged shooting of Bradley.

According to court records, Bradley and Hernandez communicated via phone and text message several times after the Florida incident, and Hernandez acknowledged “rocking” Bradley, which he interpreted as an admission that he shot him.

Rankin & Sultan received the phone about a month ago, after prior court hearings on the matter, from another firm that represented Hernandez previously.

In a brief filed with the Supreme Judicial Court ahead of Tuesday’s hearing, District Attorney Daniel F. Conley’s office said Hernandez’s lawyers have had ample time to review the phone’s contents and provide legal advice to their client.

“[D]efense counsel may retain the cell phone to provide legal advice for a reasonable time,” prosecutors wrote. “Moreover, use of a search warrant to seize the evidence does not implicate the defendant’s right against self-incrimination.”

But Hernandez’s lawyers countered in their own brief that the phone is privileged, in part because prosecutors are barred from obtaining it “due to the combined effect of [Hernandez’s] right against self-incrimination and the so-called ‘Fisher rule.’

That rule, defense lawyers wrote, holds that “a lawyer who receives documentary evidence from a client for the purpose of rendering legal advice stands in the shoes of the client by virtue of the attorney-client privilege.”

The high court took the issue under advisement.

MA Supreme Court hears case on Hernandez cell phone

Updated: May 03, 2016 2:51 PM PDT - Video at link

BOSTON (WHDH) - Lawyers in the Aaron Hernandez double murder trial appeared before the state's highest court on Tuesday. Suffolk County prosecutors asked the justices to order Hernandez to turn over his cell phone.

Prosecutors believe the cell phone contains critical evidence in connection with the former Patriots superstar's upcoming double murder trial.

    SNIP

In this matter, the convicted killer's lawyers maintain the cellphone is protected by the attorney-client privilege, which is protected by the law.

The justices have taken the matter under advisement and will likely issue a ruling within a couple of months.

Jose Baez to represent Aaron Hernandez

Casey Anthony's former attorney helping ex-NFL player appeal murder conviction

By [Only registered and activated users can see links. ] - Investigative Reporter
    Updated: 4:58 PM, June 07, 2016

Central Florida attorney Jose Baez will represent Aaron Hernandez as the former NFL player attempts to overturn his conviction for a 2013 murder, News 6 has confirmed.

Baez will also represent Hernandez in an unrelated double homicide case, sources tell News 6.

Baez recently met with Hernandez at a Massachusetts prison where the former New England Patriots tight end is serving a life sentence for shooting and killing Odin Lloyd. Baez reached an agreement to represent Hernandez Tuesday afternoon, News 6 has learned.

Baez is best known for representing [Only registered and activated users can see links. ] the Orlando mother who was acquitted of murdering her 2-year-old daughter Caylee in 2008. During Anthony’s trial, Baez told jurors the child accidentally drowned in a backyard swimming pool.

In April 2015, a jury convicted Hernandez of fatally shooting Lloyd at an industrial park about a mile from the football player’s home. At the time of his murder, Lloyd had been dating the sister of Hernandez’s fiancé.

Ex-NFL star, convicted murderer Aaron Hernandez hires Casey Anthony's attorney
    8:24 a.m. EDT June 9, 2016

[Only registered and activated users can see links. ]

BOSTON - Aaron Hernandez has hired the lawyer who famously won an acquittal for Florida mom Casey Anthony to represent him in his upcoming double-murder trial.

The former New England Patriots star has retained Orlando attorney Jose Baez. The legal team will also include Harvard law professor Ronald Sullivan and New York City lawyer Alex Spiro.

Spiro has confirmed the arrangement to The Associated Press.

Hernandez is awaiting trial for a 2012 double murder in Boston and has pleaded not guilty. He was convicted and sentenced to life in prison last year in the 2013 killing of a man who was dating the sister of Hernandez’s fiancee. His lawyers in that case, James Sultan and Charles Rankin, tell the AP in a statement that they “wish Aaron the best.”

Baez gained fame during Anthony’s 2011 trial on charges that she murdered her 2-year-old daughter, Caylee. The case garnered national media attention after photos showed Anthony partying in the days after her daughter’s disappearance

Jose Baez to defend Aaron Hernandez

    Thu June 9, 2016

[Only registered and activated users can see links. ]

A top Florida lawyer who stunned the nation when he won a murder acquittal for a mother accused of killing her toddler has taken on another high-profile, high-hurdle case.

Jose Baez announced Wednesday he was defending former New England Patriot standout Aaron Hernandez in his upcoming double-murder trial.

Baez, best known for his defense of Casey Anthony, said he realized Hernandez was the subject of much speculation in the court of public opinion -- after being indicted in three homicides -- but asked the public to keep an open mind "and let the facts unfold in a court of law."

"I have fully committed myself to ensuring a fair and just trial for Mr. Hernandez," Baez said in a statement. "To accomplish this, I have assembled the best legal team in the country to serve as co-counsel."

The Miami lawyer said he had recruited Harvard law professor Ronald S. Sullivan Jr., top defense trial lawyer Alex Spiro and Linda Kenney Baden, an expert in forensic science

Hernandez faces bevy of court cases, so far 0-1

Hernandez, 26, who already was convicted in 2015 of a murder in Massachusetts, is charged with shooting to death two men in 2012 outside a Boston nightclub because one had had caused him to spill his drink, prosecutors contend.

Daniel de Abreu and Safiro Furtado were shot as they sat in their BMW. Hernandez is also charged with shooting a witness to the killing while the two were vacationing in Florida at a Super Bowl Party in 2013. Hernandez pleaded not guilty to the witness shooting last year.

Prosecutors said Hernandez also wounded another passenger when he killed de Abreu and Furtado. Two others passengers were uninjured, authorities said.

The families of de Abreu and Furtado filed civil suits against Hernandez, and a judge froze his $5 million in assets pending the outcome of the trial. The freeze includes a disputed $3.3 million signing bonus payment Hernandez says he is owed by the New England Patriots.

In April 2015, he was sentenced to life in prison without the possibility of parole after being convicted of murdering his onetime friend and future brother-in-law, Odin Lloyd, in June 2013

Aaron Hernandez News Update: Alleged Odin Lloyd Killer Carlos Ortiz Considering Plea Deal
    Jun 18, 2016 05:01 PM EDT

[Only registered and activated users can see links. ]

The last of Aaron Hernandez's alleged accomplices to face trial in the killing of Odin Lloyd is rumored to be considering a plea deal with prosecutors.

Court records show attorneys for Carlos Ortiz and Bristol County prosecutors have scheduled a change of plea hearing for June 27 in Fall River Superior Court. Two other status review hearings also scheduled for the month of June have already been canceled.

    Ortiz's Attorney Confirms Talks

Ortiz's attorney, John J. Connors, recently confirmed that the two sides were negotiating a deal, but declined to reveal what charge his client might plead guilty to.

The 30-year-old Ortiz is scheduled to go to trial on Oct. 7, on murder and accessory to murder after the fact charges stemming from the June 2013 execution-style killing of Lloyd.

Aaron Hernandez associate pleads guilty for role in Odin Lloyd murder
    June 27, 2016

[Only registered and activated users can see links. ]

An associate of Aaron Hernandez, the former New England Patriots star convicted of murder, pleaded guilty Monday to being an accessory after the fact to the 2013 North Attleborough murder of Odin L. Lloyd of Boston by Hernandez.

Carlos A. Ortiz had been facing a charge of first-degree murder, along with an accessory charge. He entered his plea in Bristol Superior Court. He was sentenced to 4 1/2 to 7 years in prison.

Hernandez was convicted in 2015 of shooting Lloyd, a Dorchester man who was dating the sister of Hernandez’s long-time girlfriend. Hernandez, Ortiz, and a third man, Ernest Wallace, picked Lloyd up in Dorchester and drove to a North Attleborough industrial park, where Lloyd was shot to death.
Hernandez, Wallace, and Ortiz were all charged with murder. Wallace, 44, was acquitted of murder this May, but was convicted of being an accessory after the killing and sentenced to serve up to seven years in state prison.

Aaron Hernandez’s defense dream team to debut today

    Laurel J. Sweet Thursday, July 21, 2016

[Only registered and activated users can see links. ]

Convicted murderer Aaron Hernandez and his new defense dream team will make their first public appearance together at a hearing this afternoon in
Plymouth Superior Court.

The proceeding is expected to address defense motions pertaining to double-homicide charges Hernandez, 26, has pending in Boston, but will also afford his new attorneys — led by Miami-based Jose Baez — the opportunity to file their appearance.

Baez famously won an acquittal in 2011 for Casey Anthony, the Orlando, Fla., mother accused of murdering her 2-year-old daughter, Caylee. Hernandez’s high-powered legal team will also include Harvard law professor Ronald Sullivan and New York City lawyer Alex Spiro.

Court Hearing In Double Murder Case

8/16/2016 6:25 AM PDT BY TMZ STAFF

[Only registered and activated users can see links. ]
Convicted murderer Aaron Hernandez is expected to appear in court Tuesday -- where a judge is hoping to set a trial date for the double murder the ex-NFL star is accused of carrying out in 2012.

Hernandez is currently serving a life sentence for the 2013 slaying of Odin Lloyd -- but he's also accused of gunning down 2 men in a drive-by shooting after leaving a nightclub in Boston.

Prosecutors say Hernandez killed the men because one of them spilled a drink on him inside the club.

The 26-year-old ex-New England Patriots star is scheduled to appear in Suffolk Superior Court for a status hearing and the judge has said he hopes to set a start date for the trial.

Hernandez is now armed with a brand new lawyer -- Jose Baez, who famously led Casey Anthony's defense when she was accused of murdering her daughter.

Aaron Hernandez to Lawyer:Dude, You Murdered My Name

8/16/2016 11:38 AM PDT BY TMZ STAFF - VIDEO INCLUDED

Funny moment in the [Only registered and activated users can see links. ] court hearing ... well, as hilarious of a moment as you can get in a double murder case.

Moments after the hearing began, the lawyers in the case went around the room introducing themselves and saying who they represent.

Aaron's famous lawyer, Jose Baez, said he was in court "on behalf of Aaron Rodriguez."

    Oopsies.

Court rules prosecutors can search Aaron Hernandez's cellphone
    11:35 AM CT

[Only registered and activated users can see links. ]

Prosecutors can examine a cellphone owned by former New England Patriots player Aaron Hernandez for possible evidence in his upcoming double murder trial, the highest court in Massachusetts ruled Friday, ending a long-running legal battle.

Hernandez gave the phone to his former attorney in 2013 when he was being investigated in the killing of Odin Lloyd. The former tight end was convicted in that case and is serving a life sentence.

Hernandez is now awaiting trial in the 2012 killings of two men he encountered at a Boston nightclub. Prosecutors say Hernandez was angry that one of the men accidentally bumped into him at the club and caused him to spill his drink. Hernandez is also accused of shooting and wounding a friend, Alexander Bradley, to keep him from talking about the killings.

Bradley was with Hernandez the night of the killings and is expected to be the star prosecution witness at his trial, scheduled to begin in February.

Hernandez's former attorneys had argued that they had the right to keep the phone because Hernandez had given it to them at a time when he was seeking legal advice while under investigation in Lloyd's killing.

In its ruling, the Supreme Judicial Court found that once Hernandez's attorneys downloaded the contents of the phone, they had "no legitimate purpose" for keeping it

"In such circumstances, the continued retention of this device can only be understood as having the effect of concealing or removing it from the observation of others, namely the Commonwealth," Justice Francis Spina wrote for the court.

Suffolk District Attorney Daniel Conley said prosecutors have already begun the process of seeking a search warrant for the phone.
