    Local Jackson residents react to delayed Holly Bobo trial

    JACKSON, Tenn. – “And if they don’t have any consequences for their actions then what’s gonna happen?” John Bond, a Jackson native, said.

    The family of Holly Bobo has been waiting three years for this trial to begin, and now they have to wait another 2 months. The trial was pushed back to September after a new piece of evidence was introduced.

    “If they have found a weapon I think they do need time to do the forensics on the weapon so it can be used in the case to prosecute,” Mal Matthews, a Jackson native, said.

    Then on friday, the WBBJ News Room received a court document. It says that four men have been given immunity in the case. One of them, Shayne Austin, is dead.

    That means that anything they say during their testimony cannot be used against them in this case.

    One woman said that her family has experienced something very similar to the Bobo family and every day they work to overcome.

    State Believes They Have Holly Bobo Murder Weapon

    SAVANNAH, Tenn. - State prosecutors believe they finally have the weapon used to kill nursing student Holly Bobo. It was a shocking revelation that came on the same day the trial of one of her accused killer's was scheduled to get underway.

    Court documents reveal that state prosecutors believe a recently discovered gun is the murder weapon used to kill Bobo all those years ago, calling it a "critical piece of evidence."

    The gun is listed as an Arminus model HW5, 32 caliber Smith and Wesson long revolver. It's still unclear where the gun was found or how it was found but it's cartridges have been tested for blood. The earliest mention of the gun being found was on May 26, 2017.

    Defense attorneys for Zach Adams, one of three men accused of kidnapping and killing Holly Bobo, have asked the gun be excluded has evidence.

    Last week, Judge Creed McGinley was forced to delay the start of the trial because defense attorneys argued they haven't had time to analyze or process the gun.

    As for an immunity agreement given to Jason Autry who's also accused of killing Holly, documents reviewed by NewsChannel 5 reveal that the state is considering reducing his charges in return for "truthful" testimony during Zach Adam's trial.

    Jason Kilzer, a known associate of Zach Adams, was also listed as a fifth person given immunity by state prosecutors. Michael Alexander and Victor Dinsmore will also not face prosecution for any testimony they may give during Adam's upcoming trial in September.

    Defense attorneys have also asked for all rape charges to be dropped because "it is undisputed that no evidence regarding the alleged rape of Ms. Bobo will be presented to the jury."

    New details have emerged about the gun found during the Memorial Day weekend that was linked to the murder of nursing student Holly Bobo. According to a new report, state prosecutors believe the gun was used to kill 20-year-old Bobo, who went missing in 2011.

    The trial in the case was delayed last week after authorities said they did not have enough details on the recently discovered weapon. However, court documents reveal the gun is now a "critical piece of evidence."

    The gun, found by Tennessee Bureau of Investigation, is listed as an Arminus model HW5, 32 caliber Smith and Wesson long revolver. The gun's cartridges have been tested for blood but no other detail is currently available. Defense attorneys for Zachery Adams, one of the three men accused of kidnapping and killing Bobo, have asked the gun be excluded as evidence, according to the local networks.

    Adams’ trial was scheduled to begin last week, but new evidence in the case forced the delay. The judge granted the motion to continue the trial until September.

    SAVANNAH, Tenn. — Hundreds of pages of court documents provide new insight into the case against Zach Adams, one of the men charged with raping and killing Decatur County nursing student Holly Bobo.

    Adams’ attorney does not want evidence from an Arminius model HW5, 32 S&W Long Revolver introduced at trial, according to court documents. The prosecution called the gun a "critical piece of evidence," according to court documents. Judge Creed McGinley delayed the trial until Sept. 11 after the defense asked for testing on the gun.

    Adams’ attorney also motioned for another change of venue. According to court documents, the defense claimed more than 97 percent of qualified jurors have heard or discussed the case, over half have participated in conversations about it with family or friends, and more than a third have received or seen information from flyers, postcards or posters distributed by the Bobo family or support groups.

    According to court documents, it is unclear if the state will call Adams’ brother, John "Dylan" Adams, as a witness. Dylan reportedly incriminated himself and Zach, according to court documents. The state said Jason Autry, one of the other men originally charged in Bobo’s death and disappearance, will testify, according to court documents. Autry has been granted immunity in the case, according to court documents.

    A fifth man has been granted immunity in the case of murdered nursing student Holly Bobo.

    Channel 4 reported last week that Shayne Austin, Jason Autry, Michael Alexander and Victor Dinsmore had been given immunity deals in exchange for their testimony. Jason Kilzer has also been given immunity, Channel 4 learned.

    Kilzer has faced statutory rape charges in Decatur County. He has served time for burglary and theft in Henderson County.
    In September 2013, Kilzer was indicted in federal court along with Holly Bobo murder suspect Dylan Adams. According to court records, the indictment was in connection with a gun.
    According to the indictment, Dylan Adams gave Kilzer the gun, a .38 caliber revolver along with four rounds. *
    Both Dylan Adams and Kilzer are accused of selling and disposing of the gun,*moving it across state lines, and, according to the indictment, the gun's serial number had been removed.

    This was not the gun the state recently discovered in the Holly Bobo murder case, according to records.
    The recently discovered gun is listed as an Arminius HW5 .32-caliber Smith and Wesson long revolver. In court documents, defense attorneys said*they "anticipate the state will attempt to introduce it as the alleged murder weapon."*
    Defense attorneys have also filed a motion for another change of venue to select a jury from somewhere besides Hardin County. The defense cited Channel 4 News stories

    They said*there has been more coverage of this crime than any other in the history of Hardin County.
    They also said*out of the 70 potential jurors 36 claimed to know about Holly Bobo's murder,*including one woman who posted about it on Facebook.*
    Dozens of motions have been filed. The judge plans to rule on them on Aug. 9, then barring any more delays, the case is set to go to trial on Sept. 11.

    The Holly Bobo murder trial is scheduled to start September 11, 2017. In Hardin County Court Wednesday morning, attorneys for Zach Adams, who is the first suspect to be tried with Bobo's murder, pushed to get the trial delayed until January.
    The judge said no and also repeated what he said last year about what won't be allowed when the trial starts.
    "I will not tolerate signs, placards, T-shirts; anything like that could be perceived as trying to influence the prospective jurors," *the judge said back in 2016.
    In a shocker, the state hinted at something that could indicate how Holly Bobo died. They said experts found an indentation in the nursing student's skull similar to that of a bullet hole.

    There was also another sign this trial may be a long one: The state says it plans to call 200 witnesses.
    The defense says it will take them a week to present their case, meaning it may be a long time for the Bobo family to get the justice they have been seeking.
    Twenty-year-old Holly Bobo was kidnapped from her family home in Decatur County, Tennessee, in April 2011. It wasn't until 2014 that suspects Zachary Adams, Dylan Adams and Jason Autry were indicted.

    Judge in Bobo case cited for gun incident airport

    The judge in the Holly Bobo case was cited last week for having a gun at the Memphis International Airport
    Judge Creed McGinley was cited with a misdemeanor last Monday for bringing a gun into a restricted area of the airport.
    The Holly Bobo murder trial is set to begin Monday. The Decatur County nursing student was murdered more than six years ago.
    Thursday marked three years to the day that Bobo’s remains were found in the woods.
    Bobo’s trial has been delayed twice already. Local attorney David Raybin said because this incident is a misdemeanor, it likely won’t affect the trial.

    “In my opinion, there is certainly no reason for the judge to be excused from the case,” Raybin said. “He certainly has the right to recuse himself if he wishes, but there is no statutory procedure or requirement that he be removed from the case because of his citation and a misdemeanor offense. If this were a felony, certainly the answer would be much different.”

    A jury of 15 men and women has been selected to hear the case against Zachary Adams in the death of 20-year-old Decatur County nursing student Holly Lynn Bobo.
    Jury selection began Saturday morning with more than 70 potential jurors called in for final questions.
    Selection ended around 4:30 p.m.
    Some of those questions included feelings on the charges Adams faces, which are felony first-degree murder, especially aggravated kidnapping and aggravated rape, the types of witnesses who could be called to testify, and how the knowledge of promises made to witnesses who have knowledge about the crime

    Attorneys started questioning around 25 potential jurors at 9:30 a.m., excusing eight by 12:30 p.m. when the court took a recess for lunch.
    Adams' trial is scheduled to begin Monday.

    Monday, Sept. 11, is set to be the first day in the long awaited murder trial for Zach Adams.
    Adams is the first of three men heading to trial in the kidnapping, rape and death of Decatur County nursing student Holly Bobo.
    Newly filed court documents show the state is planning to call experts Dr. Hugh Berryman and Dr. Dana Medlin to the stand.
    Berryman is a forensic anthropologist expected to talk more about the skeletal remains of Holly Bobo. Medlin is expected to talk more about the alleged murder weapon, a .32-caliber revolver.
    For the defense, Rebecca Earp is expected to testify as an alibi witness, and they also are expected to call a cellphone expert and an expert to analyze the handwriting of the defendant.
    So far, over 100 subpoenas have gone out in the long-awaited trial.

    The trial is set to start at 9 a.m. Monday.

    Murder of Holly Bobo

    Holly Lynn Bobo (October 12, 1990 – c. April 13, 2011)
    was an American woman who disappeared on April 13, 2011 from her family home in Darden, Tennessee. She was last seen alive by her brother shortly before 8 a.m. walking into the woods outside her home with a man wearing camouflage. In September 2014, her remains were found in northern Decatur County, Tennessee, and her death was ruled a homicide.[1] According to prosecutors, an indentation found on her skull is consistent with that of a bullet wound.[2]
    Six men have been arrested for varying degrees of involvement in the crime. However, only three of the six men arrested have been prosecuted.[3] The prosecution has been heavily criticized for their refusal to produce evidence against the defendants, missing multiple discovery deadlines, and for making frequent changes to the charges against the defendants with little explanation. Three men are facing charges of especially aggravated kidnapping, first-degree murder and rape. Prosecutors are seeking the death penalty.[4] Of the other three men arrested, charges against two men were dropped, and one committed suicide without any charges being filed against him.


    Most of the arrests were made on the basis of a confession by John Dylan Adams, who told police he saw his brother, Zach, and another friend, Jason Autry, with Holly at his brother's home after her kidnapping. It is unknown what led police to question Dylan about Bobo's disappearance. He has since alleged that the confession was coerced. All of the accused men denied involvement in the disappearance and very little evidence has been released.[5] Defense attorneys for the men complained that they still had yet to receive a bill of particulars detailing the case against their clients and the results of forensic testing done on evidence from the case over a year after the arrests were made and that the prosecution had missed multiple discovery deadlines, leading attorneys for the defendants to file motions to dismiss charges on the grounds of "silence or stonewalling".[6][7][8][9] In July 2015, it was announced that the defendants finally received access to all the evidence against them, although it still has yet to be released to the public.[10] In February 2017, the defense attorney for Zach Adams said that they still had not yet received all of the discovery and that there was no DNA evidence linking her client to Bobo's murder

    The case has been met with several setbacks such as the death of a suspect, multiple changes to the prosecutorial team, and disputes with the Tennessee Bureau of Investigation (TBI). The TBI even briefly withdrew its services to the entire district after the prosecutor accused them of compromising the case by proceeding "so slowly that the culprits were always one step ahead and that TBI... was leaking information and possibly covering up evidence."

    On a normal day, about 7,000 people call Savannah home, with another 20,000 spread throughout Hardin County.
    But starting Monday another 200 are going to move into town, ready to watch or testify in the Holly Bobo trial.
    Chamber of Commerce Director Marilee Tice and Tour Hardin County Director Beth Pippin know that those 200 people are likely unfamiliar with Savannah, and they hope that through their roles, they can help those spending their days at the Hardin County courthouse, next door to their office at the Tennessee River Museum.

    "We want to be that conduit to help them find what they need while they’re here," Tice said.
    Whether that means pointing them in the direction of a restaurant or finding something to do on a Saturday after the trial ends for the day, the women said they want to be able to make the stay in Savannah as easy as possible.

    "Yes, visitors will be dining, buying gas, incidentals, staying in our hotels. Yes, our businesses will benefit from this," Pippin said. "We just wish for a speedy, fair justice for all involved."
